If you’re experiencing domestic abuse and feel frightened of, or controlled by, a partner, an ex-partner or family member, it’s important to remember that it’s not your fault and there is no shame in seeking help.

Online and local support for people affected by domestic abuse
Free, confidential support and advice is available to victims and their concerned family members or friends, 24 hours a day from Refuge’s National Domestic Abuse Helpline on 0808 2000 247
There is local support available from Rising Sun. They provide in person domestic abuse support at their One Stop Shops, in Ashford Folkestone and Canterbury, no appointment is needed
Court orders to stop an abuser contacting you
You can use form FL401 to apply for:
- a non-molestation order to protect you or a child from abuse or harassment, or to stop someone coming to or near your home
- an occupation order to ask the court to decide who should live in or return to your home or any part of your home
These orders are types of injunctions. Depending on your situation, you can apply for one of these orders, or both.
There are no court fees for applying.
Applying for a Court Order through CourtNav
CourtNav is an online tool designed to help survivors of domestic abuse, of any sex or gender, across England and Wales with completing an application form to apply to the family court for a protective injunction or an order to say who lives in the family home.
You will be set up with an online account to then complete some easy to understand questions. Once you submit your form, your case will be collected by one of your chosen firms. All of these firms offer legal aid and will check your legal aid eligibility.
Whether you are eligible for legal aid or not, you will be advised by either your allocated law firm or a CourtNav team member.
If an application to the court for these orders is not assessed as being appropriate, you will be advised on the best next steps for you and signposted to services that will be able to help you.
